Identification
- Valid, unexpired government photo ID for every signer
- Driver’s license, passport, state ID, military ID or permanent resident card
- The name on the ID must match the name on the document
- Expired ID is not accepted under New York notary law
The documents
- Every page, in order, with nothing signed yet
- All blanks filled in; a notary can’t complete them for you
- If the notary block is missing, we attach a New York statutory certificate
- For apostilles: the certified original with a raised seal, not a photocopy
Signers and witnesses
- Every signer present, awake, aware and willing
- Wills: two adult witnesses who are not beneficiaries
- Powers of attorney: two witnesses; the agent can’t be one
- Health care proxy: two adult witnesses; the agent can’t be one
Special cases
- Hospitals: tell the nursing station we’re coming and have the patient’s ID in the room
- Entities: bring the resolution or operating agreement showing who can sign
- Apostilles: tell us the destination country so we know apostille versus legalization
- Translations: send us the exact spelling of names as they appear on passports
